**II Construction LLC d/b/a Watchtower Data**

1. Who we are

II Construction LLC d/b/a Watchtower Data ("Watchtower", "we", "us") operates watchtower-data.com

(the "Service"), a subscription property information platform covering Dallas

County, Texas.

By creating an account or using the Service you agree to these Terms. If you

do not agree, do not use the Service.

2. What the Service is, stated plainly

**Watchtower publishes public records and the dates they were recorded.**

We assemble information published by public agencies, organise it by property,

and present it with the date each record carries. We do not verify, correct,

reconcile, interpret, score, rate or rank the records we publish. We do not

tell you what any record means.

**Every record is presented as recorded, in the edition we captured it from.**

Where an edition of a dataset contains no record for a property, we say so.

Where a record exists but a value is not published in that edition, we say

that instead. We do not fill gaps.

3. What the Service is not

**Read this section carefully. It is the most important one.**

- **Not an appraisal.** Values shown are values published by a taxing

authority, not appraisals, valuations, or opinions of market value.

- **Not a title search, title report, title opinion, or title insurance.** We

do not determine ownership. Ownership fields are records as published and

may be outdated, incomplete, or superseded.

- **Not a survey, a lien search, or a judgment search.**

- **Not investment, legal, tax, financial, or real-estate advice.**

- **Not a consumer report** as defined by the Fair Credit Reporting Act, and

the Service may not be used for any purpose regulated by that Act,

including tenant screening, employment screening, credit decisions, or

insurance underwriting.

- **Not complete or current.** Records are drawn from dated captures. A

capture is a snapshot; the underlying public source continues to change

after it is taken. Information may be out of date at the moment you read it.

**You must independently verify anything you rely on.** Decisions about real

property carry material financial consequence, and the Service is a starting

point for diligence, never a substitute for it.

4. Accuracy, and errors in the source

Records may contain errors that originate with the agency that published

them. We publish those records as recorded rather than correcting them,

because a silent correction is indistinguishable from a fabrication.

**We do not warrant that the Service is accurate, complete, current, or fit

for any purpose.** The Service is provided "as is" and "as available."

5. Your account

You must provide a valid email address and keep your credentials secure. You

are responsible for activity under your account. One account is for one

person or one business entity; accounts may not be shared.

You must be at least 18 and able to form a binding contract.

6. Subscriptions, billing and cancellation

**Price.** $20.00 per month, in US dollars, unless a different price is

displayed at the time you subscribe.

**Billing.** Subscriptions renew automatically each month on the date you

subscribed, and your payment method is charged automatically, until you

cancel. Payments are processed by Stripe; we do not receive or store your

card number.

**Promotional codes.** A promotional code may reduce or eliminate the charge

for an initial period. **When that period ends the subscription renews at the

standard price automatically unless you cancel.** Promotional codes may be

limited in number, restricted, or withdrawn at any time before redemption.

**Cancellation.** You may cancel at any time from your account. Cancellation

takes effect at the end of the period you have already paid for. You keep

access until then.

**Price changes.** We may change the price with at least 30 days' notice by

email to the address on your account. The new price applies from your next

renewal after the notice period. If you do not accept it, cancel before then.

7. Refunds

See the Refund Policy, which forms part of these Terms.

8. Acceptable use

You may use the Service for your own business or personal property research.

**You may not:**

- scrape, crawl, spider, harvest, or systematically download the Service, by

any automated means, at any rate

- reproduce, resell, redistribute, sublicense, or publish the contents of the

Service, in whole or in substantial part

- attempt to reconstruct, extract, or rebuild the underlying assembled

dataset, or any material portion of it

- share account credentials, or provide access to people outside your account

- circumvent, disable, or interfere with rate limits, access tiers,

authentication, or any other technical measure

- use the Service for any purpose prohibited by section 3, including any

purpose regulated by the Fair Credit Reporting Act

- use the Service to harass, stalk, locate, or intimidate any person

**On the underlying records.** The public records themselves originate with

public agencies and our presentation of them does not make them ours. What is

ours is the assembly: the selection, joining, structuring, arrangement and

presentation of those records, together with the software that produces it.

That assembly is protected, and section 8 protects it.

**We may suspend or terminate an account that violates this section,

immediately and without refund.** Automated access at scale is the specific

harm this section exists to prevent.

9. Availability

We do not guarantee uninterrupted availability. We may modify, suspend, or

discontinue any part of the Service, and we will give reasonable notice of a

discontinuation that materially reduces what a paid subscriber receives.

**Features are added and changed over time.** A subscription is to the

Service as it exists from time to time, not to any particular feature.

10. Limitation of liability

To the maximum extent permitted by law:

- We are not liable for indirect, incidental, special, consequential,

exemplary or punitive damages, or for lost profits, lost opportunity, lost

data, or business interruption.

- **Our total liability arising out of or relating to the Service is limited

to the amount you paid us in the twelve months before the event giving rise

to the claim.**

- Nothing here excludes liability that cannot lawfully be excluded.

**You accept that property decisions are yours.** We publish records; what you

conclude from them, and what you do about it, is your judgment and your risk.

11. Indemnity

You will indemnify and hold II Construction LLC harmless from claims arising

out of your use of the Service, your breach of these Terms, or your violation

of any law or third-party right.

12. Privacy

See the Privacy Policy, which forms part of these Terms.

13. Changes to these Terms

We may update these Terms. Material changes will be notified by email to the

address on your account at least 30 days before they take effect. Continued

use after that date is acceptance.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to

conflict-of-laws rules. The exclusive venue for any dispute is the state or

federal courts located in Dallas County, Texas.
